GENERAL CONDITIONS OF USE AND SALE

FORME srl provides access to the website www.thatsitalia.eu (the “site”) and sells its own products under the following General Conditions of Use and Sale.

Please read these terms and conditions carefully before using the website. By using the site you accept these terms and conditions.

 

Article 1 - Purpose

These terms and conditions apply to the purchase of products, remotely via computer network, on the web site www.thatsitalia.eu belonging to Forme s.r.l. with its registered office at Via Quingenti, 30 - 43123  PARMA.

 

Article 2 - Acceptance of the general conditions of sale

The customer, by sending the order confirmation electronically, unconditionally accepts and agrees to observe the general conditions and payment terms set out below in his dealings with Forme s.r.l., declaring that he has read and accepted all the information provided to him pursuant to the aforementioned rules and regulations.

 

Article 3 - Obligations of the customer

These conditions of sale shall be examined on-line by customers visiting the site www.thatsitalia.eu before they confirm their purchases. The submission of the order confirmation implies full knowledge and full acceptance of the Conditions of Sale.

Once the online purchase process is completed, the customer undertakes to print and keep these conditions of sale, already read and accepted during the purchase process, in order to fully satisfy the requirements of article 3-4 of Italian Legislative Decree no.185/1999.

www.thatsitalia.eu is a web site that sells giftware. Purchases of the products, available as illustrated and described online in their respective descriptions and technical specifications, are made by the customer, who must be at least 18 years of age, at the price indicated therein, to be confirmed with the submission of the order confirmation.

Before confirming the purchase, the customer will be shown a summary of the unit cost of each product selected, the total cost when buying multiple items and the relevant shipping costs.

After confirming the purchase, on completion of the transaction the customer will receive an e-mail message containing the number, date and total amount of the order.

 

Article 4 - Payment

Payment for the products and any shipping charges must be paid by the customer at the moment of order confirmation using one of the payment methods available and listed on-line.

 

Article 5 - Customs

If the goods ordered from www.thatsitalia.com are to be delivered abroad, the customer may be subject to import duties and taxes, payable once the package reaches the specified destination. Any additional costs for customs clearance shall be borne by the customer. Customs policies vary considerably from country to country and it is therefore in the customer's interest to contact the local customs office for further information. It is also important to remember that, when ordering on the site, the customer is treated as an importer and therefore must comply with all laws and regulations of the country in which the goods are received. In addition, cross-border deliveries may be subject to opening and inspection of the products by the customs authorities.

 

Article 6 - Delivery of products

The products purchased shall be delivered by Forme s.r.l. via courier to the address indicated by the customer, subject to possible unavailability of the goods. Due to the Christmas and summer holidays, Forme s.r.l. does not guarantee regularity of delivery during the months of August and December

 

Article 7 - Warranties

Products purchased through www.thatsitalia.eu are subject to the rules, as applicable, of Italian Legislative Decree 2/2/02 no. 24 (Italian Official Journal no. 57, 08/03/2002) governing sales contracts and warranties relating to consumer goods and, where not expressly mentioned, to the specific provisions of the Italian Civil Code.

Such warranty shall also apply to a product that presents lack of conformity and/or any malfunction not detectable at the time of purchase, provided that the product is used properly and with due diligence, in other words, in accordance with its intended use and the specifications in any technical documentation, complying with any operating rules specified therein. The aforesaid warranty shall not apply, however, in the case of negligence, carelessness in the use and maintenance of the product, and connection to electrical installations or any other type of connection that fails to comply with standards.

 

Article 8 - Right of cancellation and withdrawal

Please view our Policy on Returns, which applies to products purchased from us. In addition to the contractually recognised right to return the purchased product within 30 days of the purchase, you may exercise the right of withdrawal within ten working days of receipt of the product pursuant to Italian Legislative Decree no. 206 of 6 September 2005 (“Consumer Code”). You can find more details on the right of withdrawal and an explanation of how to exercise said right in the Order Acceptance e-mail and in Policy on Returns.

The customer has the right to cancel the order within 24 hours after the order is made by notifying Forme s.r.l. in writing via e-mail to the address info@thatsitalia.com.

If the customer fails to take action within the specified times and in the manner provided, the contract shall be considered as completed.

If the customer has already been charged, Forme s.r.l. will arrange for re-crediting.

Pursuant to and within the limits set out in Italian Legislative Decree no.185 of 22 May 1999, the customer is entitled to exercise the right of withdrawal within 10 working days from receipt of the goods.

This right applies to all products listed on the web site www.thatsitalia.eu.

 

Article 9 - Procedure for exercising the right of withdrawal

To exercise the right of withdrawal, the Customer must, within the period specified in Article 9 of these general conditions of sale, send a registered letter with acknowledgment of receipt, or a communication via fax or telegram, confirmed by registered letter within the subsequent 48 hours, to the following address:

Forme s.r.l. will transmit the order to re-credit the cost of the goods shipped, excluding shipping charges, within the 14 working days after the customer sends the goods and not before the goods are received. This transaction will be performed via the credit institution that issued the card used or by crediting the bank current account specified by the customer.

The costs of returning the goods to the sender shall, instead, be borne by the customer. Forme s.r.l. shall consequently reject any product returned unpacked or in any manner different to the original manner, and any products for which the customer has not already fully paid the costs of the return, or in the case of failure to observe the manner and time frame prescribed by law (Article 5 of Italian Legislative Decree 185/99) for communication of exercising the right of withdrawal, or in the case where the product is not packaged with original packaging, or if it is not complete with all accessories, instruction manuals and everything originally contained.

Article 11 - Jurisdiction and competent court

This contract will be governed by Italian law. For any dispute concerning the validity, interpretation or performance of this contract, the Court of Parma shall have sole jurisdiction.

 

Article 12 - Non-transferability of the contract

Rights under the following contract may not be transferred to third parties.

PRIVACY POLICY

By this policy, Forme srl, intends informing the users visiting "www.thatsitalia.eu" Website (hereinafter, the “ Website”) of the policy established with regard to Personal Data Protection, emphasising its own commitment and care concerning protection of the privacy of visitors to the Website. You are kindly invited to read our Privacy Policy that applies both in case you access the website and decide to merely browse through it using our services, without purchasing any product, and in case you decide to make some purchases.

Browsing through the Website is free and does not require any registration, except for some areas where the user can freely and expressly provide a series of data concerning his person to access specifically identified services (e.g., to be able to proceed with purchases, subscribe to the newsletter or request information from us, etc.). Should the visitor, therefore, intend providing us with his personal data to access such additional services, he will be expressly informed pursuant to Legislative Decree No. 196 of 30 June 2003 “Personal Data Protection Code” (the “Code”) and Regulation (EU) 2016/679 “General Data Protection Regulation” (the “Regulation”), along with the indication (by way of illustration) of the purposes and methods of using the data by Forme srl, as well as the right to request at any time access to, the erasure of the data or their updating. Any reference to the Code found in the Privacy Policy, and in the Website in general, must be considered valid and effective within the limits and to the extent that the legal rules recalled remain in force subsequently to the implementation date of the Regulation (25 May 2018).


The website is not intended for children under the age of sixteen, who are also forbidden from creating an account or otherwise providing their personal data.

Pursuant to the Code and the Regulation, Forme srl provides the following information.

1. The Data Controller and Data Processors

The personal Data Controller is Forme srl, based in Via Quingenti 30 – 43123 Parma (PR), VAT n° IT00946920345, Reg. A.E.E. IT08020000001361, e-mail info@forme.it  (hereinafter “Forme”, the “Data Controller” or the “Company”).

In accordance with Article 37 of the Regulation, the Data Protection Officer may be contacted by sending an email to: adm@forme.it.

2. Types of personal data processed

To access the Website, you do not have to proceed with any registration. Inside the Website, however, there are sections requiring registration or the use of username and password (e.g. to register in the customer area or finalise the online purchasing process), or services for the use of which you have to provide your data (e.g. your data might be requested to access newsletter services, to contact us, etc.).

3. Voluntary nature of the provision of personal data

The provision of personal data is generally speaking optional. Only in certain instances, failure to provide them might entail the impossibility to access specific services and obtain what might have been requested (e.g. registration - and the provision of personal details, e-mail address, postal address, details of credit/debit card or banking coordinates and telephone number - is necessary to proceed with the purchase of online products); failure to provide such data might accordingly prevent Forme from allowing access to the Website services or reply to users’ requests. 

The data from time to time required are indicated in the data collection forms found on the Website – marking them for instance with an asterisk (*) – and the consequences of failure to provide them are set out in the specific privacy policies found on the data collection pages.

4. Purposes

The data are collected and processed for purposes strictly associated with use of the Website and its services and online purchases of products. The purposes for using the data are set out in detail in the specific information notices provided by the Website in all the instances of data collection. Therefore, we ask you to read the privacy policies that from time to time describe the processing to be carried out by Forme (e.g., for registration with the newsletter service, to access the customer area, etc.). Your data will be processed in full compliance with the legislation on privacy.

5. Method and duration of data processing and scope of disclosure

The data may be processed on both electronic and paper support (e.g., to manage purchases on the Website). Forme warrants the lawful and due processing of the personal data provided through the Website, in full compliance with the legislation in force, as well as maximum confidentiality of the data provided at the time of registration. All the information collected is transmitted through a protected connection in order to avoid it being intercepted by strangers.

Any data provided by the users will be processed for the time periods laid down in the specific privacy policies provided at the time of collecting the data.

The data will not be communicated or disseminated to third parties except within the limits and on the conditions expressly set out in the information notice from time to time provided to the user and subject to his prior authorisation.

6. Links to other websites

This privacy policy is only provided for the website www.thatsitalia.eu and not for the other websites consulted by the user via connecting links. Forme cannot be held liable for the personal data provided by the users to external subjects or to any websites linked to this Website.

7. "Profiling" and/or customisation tools

Forme does not carry out any activity of promotional and/or advertising communication without the user’s prior express consent.

8. Place of data processing

The processing associated with the services provided by the Website are carried out (i) at the office of Forme srl indicated under point 1 here above and are carried out by the persons tasked with processing by Sales & Marketing Management, (ii) as well as by the companies that provide services instrumental to management of the Website, appointed as external data processors. A full list of external data processors appointed by Forme can be requested from the contact persons mentioned under point 9 of the Privacy Policy.

9. Data subjects’ rights

By sending a notice to the e-mail address info@forme.it, you may at any time exercise the rights set out in Articles 15 to 23 of the Regulation, including knowledge of which data we are processing, in which manner and for which purpose we are using them, accessing and amending the data you have provided us or erasing them, asking us to limit use of your data, and requesting to receive or transmit your data, subject always to the possibility of amending any consent (if any have been provided).

10. Who to contact if you wish to lodge a complaint

We remind you that, should you be dissatisfied with the replies received from Forme (pursuant to paragraph 8) here above), you may in any event, if you believe that the processing related to your person breaches the provisions of the Regulation, lodge a complaint with the Authority for your personal data protection (www.garanteprivacy.it), or with the Data Protection Authority of the country in which you habitually reside or work or where the alleged breach occurred.

11. Applicable law

This Privacy Policy is governed by Regulation (EU) 2016/679 and by the national regulations applicable to the specific case, to the extent that such regulations remain in force subsequently to the implementation date of the Regulation (25 May 2018).

The Regulation ensures that the personal data processing takes place in compliance with the fundamental rights and freedoms, as well as the dignity of the data subject, especially as regards the confidentiality, the personal identity and the right to personal data protection.

12. Revision clause

Forme reserves the right to revise, amend or simply update, in whole or in part, at its exclusive discretion, in any manner and/at any time, without prejudice, this Privacy Policy, due also to the amendment of legal or regulatory provisions in the field of personal data protection. As appropriate, the amendments and updates to the Privacy Policy will be notified to the users by (i) e-mail sent to the registered Website users and (ii) publication on the Home Page of the Website, and will be binding as soon as published and communicated. We accordingly invite you to regularly access this section in order to check publication of the latest and most updated Privacy Policy or check your e-mail address.

COOKIE POLICY

1. What is a cookie and what is its purpose?

Cookies were created in 1994 by Lou Montulli, an employee of Netscape, to solve the problems relating to the limitations concerning the identification of computers connected to a web page. Without cookies, the websites are unable to know whether two requests stem from the same device, which is why it is necessary to assign some labels to them.

Cookies are saved in the hard disk or in the memory of the visitor’s computer.
